The Department of Justice has taken a firm stance by urging the Supreme Court to reject Steve Bannon’s emergency request to delay his impending prison sentence. Solicitor General Elizabeth Prelogar’s court filing made it clear that Bannon, a former adviser to President Donald Trump, has not met the stringent criteria required to justify the extraordinary relief he seeks.

After being convicted of contempt of Congress in 2022 for defying a subpoena from the House committee investigating the events of January 6, Bannon was sentenced to four months in prison. Although the district court in Washington initially allowed Bannon to remain free during his appeals process, the unanimous decision by a three-judge panel in the D.C. Circuit to uphold his conviction led the district court to lift its temporary stay, thereby ordering Bannon to report to prison.

Bannon’s legal team made an emergency request to the appellate court, attempting to delay the prison order, but it was denied by a narrow two-to-one margin. Undeterred, Bannon’s attorneys escalated the matter to the Supreme Court, seeking intervention just days before Bannon is scheduled to begin his sentence in Danbury, Connecticut.

Two primary arguments were presented by Bannon’s defense attorneys in their filing to the Supreme Court. They first contended that Bannon’s actions, although blatant, were carried out in “good faith” based on legal advice, a point they argued should be reconsidered despite earlier rejections by both the jury and the appellate court. Secondly, they highlighted an “acknowledged circuit split” regarding the decision to keep Bannon out of jail pending the Supreme Court’s review, noting that such a split constitutes a substantial question worthy of the high court’s attention.

The Supreme Court’s previous denial of an emergency request from Peter Navarro, another former Trump adviser who faced a similar conviction for contempt, sets a precedent that poses challenges for Bannon’s appeal. As it stands, Bannon’s argument appears tenuous in light of the Supreme Court’s reluctance to intervene in similar matters.

This case underscores broader concerns around accountability and the judicial process in cases involving high-profile political figures. The denial of Bannon’s request could signal a persistent judicial resolve to ensure that contempt of Congress is met with appropriate consequences, regardless of political affiliation.
