Central to this anticipation is the dissolving of regulatory frameworks and agencies that infringe upon gun rights, particularly those managed by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF), which has seen an expansion in its regulatory scope under President Biden.

Gun rights organizations are urging President-elect Donald Trump to eliminate the White House Office of Gun Violence Prevention, a creation of the Biden administration seen as a concession to gun control advocates. Lawrence Keane of the National Shooting Sports Foundation pointed out that no other office in the U.S. government is similarly tasked with undermining constitutionally protected rights, funded by the American taxpayer. Furthermore, these groups are pushing for a significant curtailment of the ATF’s regulatory powers, critiquing its efforts to regulate widely used firearms and hinder the rights of gun sellers.

In past remarks at a National Rifle Association convention, Trump pledged to counteract all Biden-era attacks on gun rights during his first days in office. This intention is met with cautious optimism by Republicans on Capitol Hill, who anticipate a partner in the White House in their quest to limit the power of the ATF, particularly concerning the National Firearms Act. The act imposes restrictive measures on short-barreled rifles and suppressors, requiring registry and taxation, provisions viewed by many as infringements on Second Amendment rights.

Representative Eric Burlison has announced plans to propose legislation aimed at dismantling both the ATF and the National Firearms Act, signaling a bold attempt to reform federal gun laws drastically. While recognizing the uphill struggle ahead, Burlison and his colleagues believe there is potential to advance the cause of gun rights, drawing on successes in state-level reforms as a blueprint for federal action.

The National Shooting Sports Foundation echoes the sentiment for change, advocating for an ATF that focuses on accountability and the pursuit of actual criminal activity threatening community safety, rather than imposing arbitrary restrictions on lawful gun owners. The push for a pro-gun ATF director is also gaining momentum, with public figures like Brandon Herrera emerging as popular candidates. Known in the firearms community for his strong stance on gun rights, Herrera represents the shift toward an administration that prioritizes constitutional freedoms.

Despite calls to dismantle the ATF, some warn of unintended consequences, such as the potential for enforcement responsibilities to transfer to the FBI, whose broader reach could pose greater challenges for gun advocates. Alan M. Gottlieb of the Second Amendment Foundation emphasizes the need for careful consideration of the implications, underscoring that the core issues lie not solely with the agency but with the legislative and regulatory framework it enforces.

As the Trump administration prepares its return, the future of gun rights in America stands at a crossroads. The ensuing political discourse will reflect the broader debate about liberty, rights, and governmental authority, with significant implications for the Second Amendment and the nation’s legacy of individual freedom.
