In a notable email from April 2021, Morens indicates there is “no worry about [FOIA] requests,” suggesting a system of sharing sensitive information on Fauci’s private Gmail or in person to avoid detection.

During his public testimony, Morens claimed he inadvertently used his personal Gmail account for official communication due to the account integration on his government-issued phone. He asserted that he did not distinguish between emails from different accounts but did not see it as problematic. In contrast, other documents indicate that he was advised by an NIH FOIA officer how to make emails “disappear” before being retrieved during investigations. In February 2021, Morens confirmed deleting emails after transferring them to his Gmail, raising significant questions about intentional obfuscation.

Morens defended his actions by stating he was unaware that deleted emails constituted federal records, highlighting a concerning perspective on his responsibilities. The subcommittee, chaired by Rep. Brad Wenstrup, contemplates criminal charges against Morens in consultation with legal advisors and the Department of Justice. Additionally, Senator Rand Paul has formally requested that Attorney General Merrick Garland open a DOJ investigation into Morens’ conduct.

This developing situation draws sharp lines between the pursuit of transparency and the potential abuse of power by governmental authorities.
